Guardianship in Texas

Watching a loved one struggle to care for themselves or make safe decisions is a heavy burden that often leads to sleepless nights and constant worry. You want to protect them, but you also want to respect their dignity. This balance is difficult to strike alone.

Texas law provides a path to protect those who cannot protect themselves. In some situations, guardianship issues arise during or after a high-conflict separation, particularly when a parent’s ability to safely care for a child becomes a concern during a divorce proceeding. At The Ramage Law Group, we serve as your guide through the legal system in North Texas. We focus on helping families in Collin and Denton Counties find the right level of support for their loved ones.

What Is Guardianship Under Texas Law?

In Texas, guardianship is a legal relationship created and monitored by a court. The court appoints a “Guardian” to make decisions for an “Incapacitated Person” (often called the Ward). This is a serious step because it involves moving legal rights from one person to another.

Texas laws and procedures evolve over time. We ensure every case reflects current standards and local court practices. In our experience with North Texas judges, the court always looks for the “Least Restrictive Alternative”. This means the court will only grant guardianship if other tools, like a Power of Attorney or a Supported Decision-Making Agreement, are not enough to keep the person safe.

Understanding the Drawbacks

While guardianship offers vital protection, it is the most restrictive legal action a court can take. We believe it is important for families to understand the trade-offs:

  • Loss of Autonomy: The Ward may lose fundamental rights, such as the right to choose where they live, marry, or even vote.
  • Intrusive Oversight: The court remains involved in the Ward’s affairs indefinitely, requiring annual reports and accountings.
  • Complexity: The process is formal and public, which can sometimes feel overwhelming for families seeking privacy.

Types of Guardianship in Texas

Texas law splits guardianship into two distinct roles. One person can do both, or the court can appoint different people depending on what is in the best interest of the ward.

Guardian of the Person

This person handles daily life, including choosing where the Ward lives and overseeing their medical care and education.

Guardian of the Estate

This person manages money and property. They must post a legal bond and file a report with the court every year to show how every dollar was spent.

How To Get Guardianship in Texas: Step-by-Step

We have observed that the process moves most smoothly when families know what to expect. Here is the typical path in Texas:

  1. The Medical Exam: A doctor must complete a specific Texas form called a “Certificate of Medical Examination” detailing the nature of the incapacity.
  2. Filing the Application: We file a sworn request in the county where your loved one lives, typically Collin or Denton County.
  3. The Attorney Ad Litem: The court appoints a separate lawyer to represent your loved one and ensure their rights aren’t restricted more than necessary.
  4. The Hearing: You will appear before a judge to provide evidence that guardianship is necessary and that you are qualified to serve.

If you have questions about where your situation fits, a short conversation can provide clarity.

Who Is Eligible to Serve?

The Texas Estates Code sets high standards for who can serve as a guardian. Generally, you must be a legal adult of sound mind with a reputation for honesty.

What Disqualifies Someone from Serving?

In our experience, courts carefully vet every applicant. A person may be disqualified if they have:

  • Criminal History: Convictions for felonies or offenses involving abuse, neglect, or financial exploitation.
  • Conflict of Interest: You cannot serve if you owe the Ward money or are involved in a lawsuit against them.
  • Lack of Capability: The court may find an individual unsuitable if they lack the education or experience needed to manage a complex estate.
  • “Notoriously Bad Conduct”: Texas law allows a judge to disqualify someone based on a history of behavior that proves they would not act in the Ward’s best interest.

Frequently Asked Questions

Is guardianship permanent?
It can be, but it stays under court review. If a person regains capacity (for example, recovering from a severe illness), we can petition the court to restore their rights.

Does a Guardian have to live in Texas?
A Guardian does not always have to live in Texas, but they must appoint a local “registered agent” to accept legal papers. The court must also find that an out-of-state guardian is the best choice for the Ward.

What is the difference between a Guardian and a Power of Attorney?
A Power of Attorney is a private contract made while a person is still healthy. Guardianship is a public court process used after a person can no longer sign legal documents or when a Power of Attorney is being misused.

Words cannot truly express the gratitude I have for Claudia Brice and the Ramage Law Group. They stood by me through a year long custody battle that was one of the hardest seasons of my life. When my son’s dad tried to take away the most important person in my world just to avoid child support, I knew I needed someone strong, relentless, and compassionate and that’s exactly what I found. I had the privilege of working closely with Claudia Brice, Jackie Bell, and Caitlyn Politz, and every single one of them went above and beyond. They were organized, responsive, and immediately took action to protect my son and me. They made me feel cared for not just as a client but as a person. Claudia is more than just an attorney she is a SUPERWOMAN in law and a true fighter with the heart of a protector. She is humble, kind, and understanding, yet fierce in the courtroom. She made sure I understood my rights and options every step of the way and even in the middle of all the stress and heartache, her funny sense of humor made me laugh when I thought I couldn’t anymore. Sitting beside her in court, I felt a peace and confidence I never thought I’d feel during such a painful time, because I knew she was fighting as if it were her own family on the line. I will forever recommend Claudia Brice and the Ramage Law Group to anyone facing a family battle. Claudia, thank you from the bottom of my heart! ❤️

Thomas with Ramage Law Group is absolutely phenomenal. He was always available to assist, answer questions that he could answer, and listened- he didn’t interrupt, he wasn’t rude, he just listened. As a mom of a child with disabilities who desperately needed assistance, it meant a lot. Dr. Brinkman even took the time out to talk to me. Although I did not receive services due to services were no longer needed, this is going to be the first place I call if I ever need services. Thank you, Ramage Law Group.
